Selling a Virginia Home with Liens — What You Need to Know.

Liens on a property feel like a locked door — but most of the time, they are not. In Virginia, liens are typically resolved at closing from your sale proceeds. You do not need cash in hand to fix them first. Here is how it works.

Five Paths Forward — I Know Every One of Them

Most “we buy houses” companies can offer you one thing — a cash offer, almost certainly below market. As a licensed Virginia agent with 20 years of experience in Frederick County and the Shenandoah Valley, I walk you through every option and tell you honestly which one serves you best.

💵
Off-Market Cash Sale
Fastest close

Close in as few as 7 days. No showings, no repairs, no contingencies. I put your home in front of thousands of investors simultaneously — they compete, you get a real number, not a single lowball.

🏠
As-Is MLS Listing
Often highest price

List on the open market as-is — no repairs, no staging. In competitive Frederick County markets, as-is listings attract multiple offers. Often produces more than a single cash offer.

🔨
Wholetail Sale
Best of both worlds

Light cleanup, priced right, sold fast — without a full renovation. Faster than traditional, higher than a deep-discount cash offer.

📋
Seller Financing
Monthly income stream

Own your home free and clear? Carry the note and collect monthly payments instead of a lump sum. Often achieves a higher total price over time.

🔑
Lease Option
Keep your options open

Rent now, sell later. Lock in a future sale price today while collecting rent in the meantime.

How Liens Affect a Virginia Home Sale

A lien is a legal claim against your property — typically for unpaid debts. To transfer clean title to a buyer, all liens must be satisfied. In most cases, this happens at closing: the title company pays off the lienholders from your sale proceeds before disbursing anything to you.

The critical number: is there enough equity in the home to pay off all liens, your mortgage, and closing costs? If yes, the transaction works. If no, you are upside-down and need a different strategy.

Common Types of Liens in Virginia

  • Mortgage liens: Your primary and any secondary mortgages. Always paid first at closing.
  • Property tax liens: Unpaid real estate taxes. Paid at closing from proceeds.
  • IRS/federal tax liens: More complex — IRS has right of redemption in some situations. Requires coordination but is resolvable.
  • HOA liens: Unpaid HOA dues and fines. Resolved at closing.
  • Mechanic's liens: Filed by contractors who were not paid. Negotiated and paid at closing.
  • Judgment liens: From court judgments against you. Attach to all real property you own in Virginia. Paid at closing.

What If Liens Exceed My Equity?

If total liens plus your mortgage balance exceed what the home is worth, you are upside-down. Options:

  • Negotiate lien reductions: Some lienholders — particularly junior lienholders — will accept less than full payoff to allow a sale to proceed. This is called a lien release or subordination.
  • Short sale: The mortgage lender accepts less than full payoff. Requires lender approval but resolves the upside-down situation.
  • Pay down liens: If you have the cash to reduce liens to a level where a sale works, that can be the cleanest path.

Will Liens Scare Off Buyers?

Not cash buyers and experienced investors. They deal with lien situations regularly and know liens resolve at closing. On the MLS, liens are disclosed and handled through the title process — it is routine.

The key is working with a title company that knows how to navigate lien payoffs, and an agent who understands the process. Dan White has done this dozens of times across Frederick County, Warren County, and Clarke County.
